Family violence / AVO
Family violence means any conduct, whether actual or threatened, by a person towards a member of their family, or towards the property of that family member, that causes the person or any other member of the person’s family to fear for, or to be apprehensive about his or her personal well-being or safety.
In the event that you are faced with any form of Family Violence, an Apprehended Domestic Violence Order (ADVO) can be applied for and obtained through the Courts to restrict the violent party’s conduct. Once an ADVO is obtained it is a criminal offence if the violent party is caught acting in breach of the ADVO.
The Family Court of Australia adopted the ‘Family Violence Best
Practice Principles’ in March 2009, which recognise the critical
importance of reducing violence directed towards women and children.
Among other things, the Best Practice Principles ensure that ADVO’s
will be explicitly considered in determining the best interests of the
child.
