De Facto

Anyone who is currently in a defacto relationship or is considering entering into one, should be aware of the recent amendments to the Family Law Act which came into effect on the 1st of March 2009.

The new laws enable defacto couples (including same sex couples) to access the Family Court or the Federal Magistrates’ Court in the same way that married couples do. Previously they could only access the State Courts, which are less accessible and more costly than the Family Courts.

You should speak to us to help you determine whether a Cohabitation Agreement under the new Legislation may help protect your rights.
