Divorce
Going through a divorce can be an emotional and challenging time.
Under the Family Law Act, you have grounds for divorce if your marriage has broken down and cannot be repaired, and you have been separated for at least 12 months. You can make the application for divorce on your own, or you and your spouse can apply together. When there are children under 18 involved, information about their care must be included in your application.Once the application is filed with the Court, a date is given for the hearing. A copy of the application must be served on your spouse (if it was not a joint application) at least 28 days before the hearing. Your spouse must also attend the hearing if there are children involved. A divorce order is given by the Court if it is satisfied that all criteria have been met.
