Litigation

Litigation is seen as being the last resort.

Family Law regulations require you to genuinely try to resolve your dispute by way of pre-action procedures such as negotiation, mediation, counselling , conciliation or arbitration before any proceedings are filed (there are some exceptions to pre action procedures).

If you cannot reach an agreement or settlement then litigation in the Family Court is commenced.
