Parenting Plans

A parenting plan is an agreement that sets out parenting arrangements for children.

It should be in writing and signed by both parents. If parents cannot reach an agreement about the care and support of their children, they can apply to the Family Court or Federal Magistrates Court for 'Parenting Orders'. These determine who is responsible for what. They cover things like where the child lives, what time they spend with the other parent and how they communicate, orders about parental responsibility and decision-making, and child maintenance.

Shared parenting

An amendment to the Family Law Act in 2006 has placed more emphasis on what is best for the child after the separation of their parents.

‘Shared Parenting’ means that both parents are responsible for the care and welfare of children, so that the children have a meaningful relationship with both. Both parents should have equal responsibility for all decisions relating to the children, such as schooling, religion and health issues.

Shared Parenting doesn't necessarily mean that there is a 50-50 care split, but the new laws mean that parents and the Court must give consideration to the amount of time spent with each parent.
