Spousal support

In certain situation spouses or de facto partners may be liable to financially maintain the other person to the extent they are able to do so.

Such situations include:
  • If the other person is unable to support himself/herself adequately and where the reason is because of his or her having the care and control of a child of the relationship who has not reached the age of 18 years
  • If the other person’s age or physical or mental state makes them incapable of gaining appropriate employment
  • For any other adequate reason; having regard to certain relevant matters.
