Mediation & Alternative Dispute Resolution
Alternative dispute resolution (ADR) processes exist as an option for individuals or businesses in dispute to try and resolve conflict other than by way of formal court proceedings.
Indeed, most courts have now formally integrated ADR processes as a way to try to help parties, in appropriate circumstances, to achieve resolution of issues in dispute prior to trial.There are many different types of ADR, the common characteristics generally being that the parties agree to a neutral third person becoming involved on a confidential basis to help them reach their own agreement. The most commonly cited advantages to an ADR process are that the procedure is less formal and costly, and there is more scope for a creative resolution to be achieved. Courts are confined to more traditional remedies.
