Dependency claims

Commonly asked questions

Parties who are entitled to claim compensation on the basis of financial dependency include the following.

  • The husband or wife of the deceased
  • The de facto partner of the deceased
  • The parent of the deceased, which includes step-parents and grandparents
  • Any children of the deceased, within or outside of marriage, which includes adopted children, stepchildren, grandchildren or any other child for whom the deceased had assumed responsibility. A child also includes a child of the deceased born after the death of the deceased.

In order to succeed in a dependency claim, you must establish that:

  • You were financially dependent on the deceased
  • The party being sued would have been liable to compensate the deceased for his or her injuries if the deceased had survived the accident

In a dependency claim, you are entitled to claim for loss of wages or earnings, loss of superannuation, medical treatment expenses and funeral expenses.
