The party you lodge the claim against will depend on the facts of your particular case.

The first potential claim is for negligence against the distributor, being the person or company that sold you the faulty product.

A claim for negligence can also be made against the manufacturer or producer of the goods.

In order to succeed in a claim for negligence, you need to prove the following.

  • The distributor or manufacturer/producer of the faulty product owed you a duty of care
  • The distributor or manufacturer/producer of the faulty product breached that duty of care
  • The breach has resulted in you suffering injury or loss
