Lawful and unlawful terminations

Some common questions about Terminations:

A dismissal is when an employer decides to terminate an employment contract. A resignation or an abandonment of employment (where the employee fails to attend work anymore), is instigated by the employee.

The amount of notice is based on the length of time they have worked for your business and their age. The employer must give written notice of the day of the termination. For more information see the Fair Work Ombudsman website.

You do not need to provide notice of termination if the employee is employed on a casual basis, if they are employed for a specified period of time or specified task or if the employee has engaged in serious misconduct (eg. theft or fraud). For more information see the Fair Work Ombudsman website.
