Drug and alcohol offences

Frequently asked questions related to drug and alcohol law in NSW:

If you have been charged with a minor drug offence, such as possessing or using a small amount of drugs, or if this is your first offence, then you may not need legal representation in court.

This will depend on the severity of the offence (including whether or not the incident in which you were caught was an accident, and whether someone was injured), whether this is your first offence or not, and what your existing traffic record is like.

Driving while over the legal alcohol limit for your license type may result in an immediate temporary suspension of your driver’s license. For more information on legal blood alcohol content (BAC) limits for different NSW road licenses, visit the RMS Website.
