Your employment contract

Some common questions about Employment Contracts:

No. The agreement between you and your employer may be verbal. However, signing a written Contract is always advisable, as breaches of Contract can be more difficult to prove when the agreement has only been made verbally.

The Fair Work website provides useful information about the minimum requirements set out in the National Employment Standards and for different awards. (www.fairwork.gov.au)

No. Most industries have a modern Award, which sets out the minimum employment standards for certain jobs in that industry. Workers in some industries may be covered by Enterprise agreements instead of a modern Award, which detail the conditions for employees at a particular workplace. An Employment Contract  is used when an employee is not covered by an Enterprise agreement or Award. But it is possible for workers under an Enterprise agreement to also have an individual Employment Contract in relation to some aspect of their employment.
